1. Introduction and Acceptance
These Terms of Service ("Terms") govern your access to and use of the Arvon platform and related services ("Service"), operated by Synaptrix LLC ("we," "us," or "our"). Arvon is accessible at arvon.app.
By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. Service Description
Arvon is an AI-powered phone receptionist platform designed for restaurants. The Service answers incoming phone calls on behalf of restaurant operators, handles reservation bookings and food orders from callers, and delivers real-time notifications to restaurant managers via SMS text messages. Arvon also provides a web-based dashboard for restaurant managers to configure their AI receptionist, view call transcripts, manage reservations and orders, and control notification preferences.
3. Eligibility and Account Registration
You must be at least 18 years old and authorized to act on behalf of the restaurant or business you register. You agree to provide accurate, complete, and current information during registration and to keep your account information up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
4. Use of the Service
You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not:
- Use the Service for any purpose other than legitimate restaurant operations.
- Attempt to reverse engineer, decompile, or disassemble any part of the Service.
- Interfere with or disrupt the integrity or performance of the Service.
- Use the Service to transmit spam, unsolicited messages, or any unlawful content.
- Share your account credentials with unauthorized parties.
5. SMS Text Messaging Program
This section describes the Arvon SMS Notification Program and contains important disclosures required under federal regulations and industry guidelines.
Program Name: Arvon SMS Notification Program
Program Description: When the Arvon AI phone receptionist handles an incoming call and takes a reservation or food order on behalf of your restaurant, the system sends an SMS text message to the registered restaurant manager's mobile phone number containing the details of that reservation or order (such as guest name, phone number, party size, reservation time, order items, and pickup time). These messages are transactional, operational notifications — they are not marketing, promotional, or advertising messages.
Message Frequency: Message frequency varies based on your restaurant's booking and order volume. You may receive between 1 and 50 SMS messages per day during peak periods. Each new reservation or order generates one SMS notification. Low-volume restaurants may receive only a few messages per week.
Message and Data Rates: Message and data rates may apply. Please contact your wireless carrier for details about your messaging plan and any charges that may be incurred.
Opt-In and Consent: Restaurant managers explicitly opt in to receive SMS notifications by checking an unchecked consent checkbox on their Arvon account dashboard after registering for the Service. The checkbox is not pre-selected and is never checked by default. Opting in to SMS notifications is entirely voluntary. Consent to receive SMS messages is not a condition of purchase or use of the Arvon service. You may use Arvon without enabling SMS notifications.
Opt-In Disclosure: At the point of opt-in, the following disclosure is displayed adjacent to the checkbox:
"I agree to receive SMS booking and order notification messages from Arvon (Synaptrix LLC). Message frequency varies based on booking and order volume. Message & data rates may apply. Reply STOP to opt out or HELP for assistance. Consent is not a condition of purchase. Terms of Service: https://arvon.app/terms | Privacy Policy: https://arvon.app/privacy"
Opt-Out Instructions: You may opt out of SMS notifications at any time by replying STOP to any message you receive from Arvon. After sending STOP, you will receive a single confirmation message acknowledging your opt-out, and you will receive no further SMS messages from Arvon. You may also opt out by unchecking the SMS consent checkbox on your Arvon account dashboard, or by contacting us at office@arvon.app. We honor all opt-out requests within 10 business days as required by FCC regulations. The following keywords are also recognized as opt-out requests: STOP, END, CANCEL, QUIT, UNSUBSCRIBE.

Supported Carriers: The Service is compatible with major U.S. wireless carriers. Carriers are not liable for delayed or undelivered messages.
Carrier Disclaimer: Synaptrix LLC and its Arvon service are not responsible for any delays or failures in SMS message delivery caused by your wireless carrier, network provider, or device settings. Wireless carriers are not liable for delayed or undelivered messages.
No Third-Party Sharing of SMS Consent: Synaptrix LLC and its Arvon service will not share, sell, rent, or otherwise disclose your mobile phone number, SMS opt-in data, or text messaging consent information to any third parties, affiliates, or service providers for marketing, advertising, or promotional purposes.
6. Fees and Payment
Use of the Arvon Service may be subject to subscription fees as described on our pricing page. Fees are billed on a recurring basis and are non-refundable except as required by applicable law. We reserve the right to change pricing with 30 days' prior notice.
7. Intellectual Property
The Service, including all content, software, designs, logos, trademarks, and other materials, is the property of Synaptrix LLC and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.
8. Data and Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to the practices described in the Privacy Policy.
9. Disclaimers
The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure. The AI phone receptionist may occasionally misinterpret caller requests; you are responsible for verifying reservation and order details.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Synaptrix LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities, arising out of or related to your use of the Service. Our total aggregate liability for any claim arising from or relating to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless Synaptrix LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
12. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may terminate your account at any time by contacting us at office@arvon.app. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including Disclaimers, Limitation of Liability, and Indemnification) shall survive.
13. Changes to These Terms
We reserve the right to modify these Terms at any time. Any changes will be posted on this page with an updated "Last updated" date. We will notify registered users of material changes via email. Continued use of the Service after changes constitutes acceptance of the updated Terms.
14. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to conflict of law principles. Any dispute arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the state and federal courts located in the State of Florida.
15. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
16. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Synaptrix LLC regarding the Service and supersede all prior agreements and understandings.
